Hospitals have an obligation to bill in a timely fashion

Q: Two and a half years ago I was hospitalized over night because of an auto accident. The hospital bill was approximately $2000.

I had insurance at that time. I have never received a bill for hospitalization before last week. I assumed the hospital had billed and collected from the insurance company that I had at the time. Out of the blue last week I received a bill from the hospital for the $2000.

I have a different insurance company now. Since it has been almost three years, am I legally obligated to pay this bill? Thank you for helping me.

A: Call the hospital and speak to the billing department. Simply ask them why there is a two and a half year delay of your bill. Find out if they billed the correct insurance company and what the response of that insurance company was. It is possible that your automobile insurance company should have been billed instead of your health insurance company. Depending on the hospital's answer, you may also want to verify coverage with both your previous health insurance company and with your automobile insurance company. I do not know which insurance company was responsible for your hospital claim. You need this information.

I do not know what the law in Mississippi is. You may want to call your insurance quality board and the attorney general's office to find out if there is a time limit for your financial liability regarding this bill. The hospital has an obligation to bill you in a timely fashion. The turn around time for a medical claim to be submitted, processed and paid by the insurance company is approximately 45 days. The hospital should have followed-up on this claim shortly after that. Timely billing is not three years after a hospitalization.
