Hospital
should pay 'stop payment' fee for checks they lost
May 21, 2004
Q:
My
father received a bill from his doctor. I wrote a check
for the full amount and hand delivered it to the doctor's
office. I received a receipt. I have been contacted
by the billing office demanding payment. I informed
them that I already paid the bill. I gave them the name
of the person who made out my receipt. They can not
find the check and want me to cancel it and write another
check. In the meantime, I just received a "Final
Demand" for payment. What should I do?
A:
Before
you stop payment and issue another check, call the bank.
Find out if the check has been cashed. If the check
has been cashed and deposited, ask who deposited it.
Ask for a photocopy. If the doctor's office cashed the
check, the problem is that the office did not post the
check correctly. Your account needs to be credited with
that payment immediately. It is up to the doctor's office
to figure out what they did with your payment.
If
the check has not been deposited, you may want to stop
payment on it. However, the bank usually charges a fee
for a stop payment. Since you have a receipt given to
you by the doctor's office verifying your payment, you
should not be responsible for the stop payment fee.
You are not the one who lost the check. Inform the doctor's
office that you will be happy to write another check
as soon as they pay the stop payment fee. You already
paid your father's bill; there is no reason why you
should have to pay additional money out of your pocket
for the billing department's error.
Until
this matter is resolved, ask the office to put a hold
on your father's account. A special notation should
be made so his account does not mistakenly end up with
a collection agency.
